Liability Waiver

This is a legal document under the laws of Ontario, Canada. Please read carefully before signing.

This agreement (“Agreement”) is made and entered into between the undersigned individual (“Participant”) and Shero Club Inc., its owners, directors, officers, employees, contractors, affiliates, successors, and assigns (“Shero Club”).

1. Acknowledgement of Risk & Voluntary Participation
   I acknowledge that participating in Shero Club’s fitness classes, personal training, wellness sessions (e.g., red light therapy, meditation, recovery tools), and use of any equipment or facilities involves inherent risks. These include, but are not limited to, muscle strain, injury, pre-existing condition aggravation, dizziness, slips, falls, emotional distress, or exposure to contagious illnesses such as COVID-19.
   I freely and voluntarily assume all such risks and accept full responsibility for any consequences resulting from participation.
2. Health Declaration
   I affirm that I am physically and mentally fit to participate in Shero Club programs. I have either consulted a physician or accept full responsibility for choosing not to. I agree to immediately notify staff of any pain, discomfort, or unusual symptoms experienced during activity.
3. Release of Liability & Waiver of Claims
   To the fullest extent permitted by law, I voluntarily release and forever discharge Shero Club from any and all claims, demands, actions, or causes of action for any injury, illness, loss, property damage, or death resulting from my participation, whether arising from negligence or otherwise.
   I agree not to sue Shero Club for any reason related to my participation.
4. Indemnification
   I agree to indemnify and hold harmless Shero Club from any claims, liabilities, costs, or damages—including legal fees—arising from my actions, including but not limited to:

• Improper use of equipment
• Violation of this agreement
• Injury to myself or others
• Damage to property

5. Use of Facilities and Equipment
   I understand and agree to use all equipment and facilities responsibly and follow all safety instructions. Shero Club is not responsible for any personal property lost, damaged, or stolen on the premises. Improper use of equipment may result in injury or loss for which I bear full responsibility.
6. Infectious Disease Release
   I understand that participation in group activities involves risk of exposure to contagious diseases, including COVID-19. I assume all such risk and agree not to hold Shero Club liable for any illness or consequence related to such exposure.
7. Media and Image Release
   Unless I provide written notice, I grant Shero Club permission to use photographs, video, or recordings of me for promotional, commercial, or educational purposes without compensation or further consent.
8. Governing Law & Jurisdiction
   This Agreement shall be governed by the laws of the Province of Ontario, Canada. Any disputes arising from this agreement shall be submitted to the exclusive jurisdiction of the courts in Toronto, Ontario.
9. Entire Agreement & Severability
   This document constitutes the entire agreement between the parties. If any portion is held unenforceable, the remaining sections shall continue in full force and effect.
10. Acknowledgment
    I have read, understood, and voluntarily signed this Agreement. I acknowledge that by signing, I waive substantial legal rights, including the right to sue Shero Club in the event of injury, illness, or death.
